Who are the developers of Vila No Mar?
Tourist operator and lodge owner Jaco Badenhorst, and his partner, Dr.Pieter Scholtz from Hoedspruit started this project in 2008. The Periodic Occupation Regulation (Decree 39/2007 of 24 August, the Periodic Occupation regulation, Regulamento de Habitação Periódica) establishes the legal regime for the constitution, exercise, transmission and extinction of periodic occupation rights.
It also defines the norms for licensing establishments (both tourism and commercial property) operating within this regime.
What does the Development look like?
Low density, low impacts on the environment, complimenting the surroundings using local building materials to build these villas and to create a Mozambican feel to the lodge. Five luxury villas have already been constructed of which four has been sold. The office is situated centrally to the lodge and boat houses can be constructed on request.
The development will have its own restaurant and will be operating as a lodge with other units to be rented out. Options of houses and plans are on the website. Can I, as a South African, purchase a holiday house in Mozambique?
Individuals may own property and fractional ownership. The Periodic Occupation Regulation therefore applies to all property or accommodation used for periodic occupation or residential tourism.
Who is responsible for the common property?
The common property i.e. roads, water pumping-, distribution system, electrical generation, shall remain under the control and managed by the Management company Vila No Mar.
What is a levy or maintenance fee?
It is the cost to operate the resort. This fee is divided amongst all the resort owners.
What are the levies?
Monthly Levy R6 540.50 including IVA – levy summary on request at the office.
Who controls the levy?
The HOA and the Management company Vila no Mar.
Who is the HOA?
Each owner by virtue of his ownership in the periodical property right shall automatically become a member of the HOA upon registration of the said right. (Home Ownership Association).
Who decides on the Levy increases?
The Home Owners association and the Management company Vila no Mar.
How are the levies applied?
Annually on the anniversary of the date of purchase, the annual levy will be invoiced. This can be paid one year in advance or in monthly installments.
What are the guarantees for levy increases, what is it linked to?
It will be decided at an annual HOA meeting and voted upon by the relevant parties.
Can units be bought as an investment and then rented out?
Yes, but in accordance with rules as determined by the "rental pool agreement".
How much can I get for being part of the rental pool?
70% of the revenue is payable to the owner and 30% is retained by management. 17% IVA is payable on total income.
What parking facilities are available?
Parking at your unit is available.
What rights does the house owner have?
The purchaser will own the fully exclusive right of use of the House. Owners, guests and invitees shall have a right of access to the development property, except in areas reserved for specific Owners guests or invitees or areas marked as no entry.
What arrangements have been put in place to manage the development?
The Management company Vila no Mar, will employ staff to manage every aspect including reservation & bookings, a property manager, cleaning staff, garden maintenance and a maintenance crew.
